DAVEY Leslie Robert & Enid Joan
Court Notice The Advertiser 13 April 1954 ADELAIDE LOCAL Before Judge Sanderson Trotting Dispute Settled In a dispute over the leasing of a trotting horse, Royal Stretta, Leslie Robert Davey, electrician and his wife, Enid Joan Davey, both of Stephen terrace, Walkeryille, yesterday sued Reginald Albert Chapman, foreman stevedore, of Northgate street, Cheltenham. The plaintiffs alleged that by an agreement dated October 20 1952, Chapman undertook to lease them the horse for two years, subject to the fulfilment of the agreement conditions. The lease terms had been strictly complied with. About December 18 last year, stated the plaintiffs, Chapman had wrongly given notice to the SA Trotting League that the agreement had been terminated, and that they were thereby prevented from racing the horse. Later Chapman had attempted to deprive them of the possession of Royal Stretta. Specific performance of the lease was claimed by the plaintiffs; also a declaration that the agreement was still in force. Asserting that Chapman's conduct was preventing them from racing the horse, the plaintiffs claimed damages for its loss of form, for training fees, and for further preparation for racing It was stated that it would take about three months to get full value from the horse in which event it should win stakes in the vicinity of £1,000. Contesting the action, and counter-claiming £500 from the plaintiffs, Chapman pleaded that they had defaulted over the agreement, whereby the lease had terminated. Chapman sought an order for the return of the horse to him; damages for its alleged wrongful detention; and for loss of earnings from racing the horse. In a reply to the counter claim, the plaintiffs denied that Chapman was entitled to the possession of the horse, for the return of which no proper demand had been made, they submitted. Such damage as Chapman had suffered had been brought about by his own conduct. When the hearing of the case had occupied nearly a day's sitting of the court, His Honor suggested that the parties might confer in an effort to reach a settlement. They did so, and on resumption of the case counsel announced that settlement, the terms of which were not disclosed, had been achieved. Mr. C. H. Mutton for the plaintiffs: Mr. L. M. Wright for the defendant.
